Last updated: January 2024

1. Acceptance of Terms

By accessing and using Adventure Australia's website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Adventure Australia. If you do not agree to these terms, please do not use our services or website.

We reserve the right to modify these terms at any time without prior notice. Your continued use of our services after any changes indicates your acceptance of the modified terms. We recommend reviewing these terms periodically to stay informed of any updates.

2. Service Description

Adventure Australia provides active holiday booking services, adventure tour planning, and outdoor activity coordination throughout Australia. Our services include but are not limited to guided tours, equipment rental, accommodation bookings, transportation arrangements, and educational workshops related to outdoor activities.

We act as an intermediary between customers and various service providers including tour operators, accommodation providers, equipment suppliers, and transportation companies. While we strive to ensure quality service delivery, we are not directly responsible for the actions or services provided by third-party vendors.

3. Booking and Payment Terms

All bookings are subject to availability and confirmation by Adventure Australia. A deposit may be required at the time of booking, with the balance due according to the payment schedule specified in your booking confirmation. Payment terms vary depending on the specific adventure package and duration.

Prices are quoted in Australian Dollars (AUD) and include applicable taxes unless otherwise specified. We reserve the right to adjust pricing due to currency fluctuations, changes in supplier costs, or government-imposed taxes and fees. Price changes will be communicated to customers before final booking confirmation.

4. Cancellation and Refund Policy

Cancellation policies vary depending on the specific adventure package and timing of cancellation. Generally, cancellations made more than 30 days before the scheduled departure date are eligible for a full refund minus administrative fees. Cancellations made between 15-30 days may incur a 25% penalty, while cancellations within 14 days typically forfeit 50% of the total booking cost.

In cases of extreme weather conditions, natural disasters, or circumstances beyond our control that result in trip cancellation, we will work with customers to reschedule or provide alternative arrangements. Refund policies for force majeure events will be handled on a case-by-case basis with consideration for both customer and supplier impacts.

5. Safety and Liability

Participation in adventure activities involves inherent risks including but not limited to physical injury, property damage, or in extreme cases, death. All participants must be in good physical health and disclose any medical conditions that might affect their ability to safely participate in planned activities. We strongly recommend comprehensive travel insurance for all bookings.

Adventure Australia and its partners take safety seriously and implement appropriate safety measures and provide qualified guides for all activities. However, participants acknowledge and accept the inherent risks associated with outdoor adventure activities. By booking with us, you agree to follow all safety instructions and guidelines provided by our guides and partners.

6. User Responsibilities

Users are responsible for providing accurate personal information, including emergency contact details, medical conditions, dietary requirements, and fitness levels. False or incomplete information may result in booking cancellation without refund. Participants must arrive punctually at designated meeting points with appropriate gear as specified in pre-departure communications.

Users must respect local environments, wildlife, and cultural sites visited during adventures. Damage to equipment, facilities, or natural environments due to negligence or intentional misconduct will result in repair or replacement charges. Disruptive behavior that negatively impacts other participants or guides may result in immediate trip termination without refund.

7. Intellectual Property

All content on the Adventure Australia website, including text, images, logos, videos, and software, is protected by copyright and trademark laws. Users may not reproduce, distribute, or use our content for commercial purposes without explicit written permission. This includes but is not limited to tour descriptions, photographs, route information, and marketing materials.

Photography and video recording during tours may be used by Adventure Australia for promotional purposes unless participants explicitly opt out. Participants retain rights to their personal images but grant Adventure Australia limited usage rights for marketing and promotional activities across various media platforms.

8. Privacy and Data Protection

Adventure Australia is committed to protecting user privacy and personal information. We collect, use, and store personal data in accordance with Australian Privacy Principles and our comprehensive Privacy Policy. Personal information is used solely for booking management, customer service, safety purposes, and occasional promotional communications with opt-out options.

We implement appropriate security measures to protect personal information from unauthorized access, alteration, disclosure, or destruction. However, no internet transmission is completely secure, and users acknowledge the inherent risks of providing personal information online. We do not sell or share personal information with third parties except as necessary for service delivery.

9. Limitation of Liability

Adventure Australia's liability is limited to the total amount paid for the specific booking in question. We are not liable for indirect, consequential, or punitive damages including lost profits, missed opportunities, or emotional distress. This limitation applies regardless of whether the claim is based on contract, tort, negligence, or other legal theories.

We are not responsible for delays, cancellations, or modifications due to weather conditions, natural disasters, government actions, supplier failures, or other circumstances beyond our reasonable control. In such cases, we will make reasonable efforts to provide alternative arrangements or partial refunds where possible.

10. Governing Law and Disputes

These Terms of Service are governed by Australian law and subject to the jurisdiction of Australian courts. Any disputes arising from these terms or the use of our services will be resolved through binding arbitration in accordance with Australian commercial arbitration rules, unless prohibited by applicable consumer protection laws.

Before initiating formal dispute resolution, parties agree to attempt good faith negotiations to resolve any conflicts. If direct negotiation fails, mediation through an accredited Australian dispute resolution service is required before proceeding to arbitration or court proceedings.
